Privacy policy – App

We take the protection of your personal data very seriously and it is our top priority to protect it. We treat your personal data confidentially and in accordance with the legal data protection regulations and this privacy policy.

We also attach great importance to transparency and have written this Privacy Policy in a language you can understand and read.

1. Who we are

For all users from the European Union or a European country, we are responsible for your data within the scope of this privacy policy (the “Data Controller”):
Aquema UG (haftungsbeschränkt)
Hans-Thoma-Weg 1
71032 Böblingen
Germany

2. Where this privacy policy applies

This privacy policy applies in particular to the use of our app, but also to events and other services operated by Aquema.

To keep it simple, we refer to all of the above as our “services” in the following.

If a specific service has its own privacy policy, that specific privacy policy applies – not this one.

3. What data we store and process

To be able to offer our service, we have to store some data about you. We try to store as little personal data as possible about you when you use our services!

So when you create an account, you provide at least your login information and some basic details necessary to run the app, such as your date of birth and where you’re from (a country).

When you create your profile, you will answer eight questions so that other users can set them in the filter. In an area where you can enter free text (up to 200 characters), you can, for example, enter information about your personality, lifestyle and interests or other information about yourself.

You must also have a profile photo and can add more photos. In doing so, you allow us to access your camera and your photo album. Some of the information you voluntarily provide may be considered “special” or “confidential” in some jurisdictions, such as information about your sexual orientation or religious beliefs. By choosing to provide this information, you are consenting to our processing of this data.

When using the app, we store the following data that you provide us with:

  • User name
  • Email address
  • Date of birth
  • Country
  • Language
  • Profil text
  • Uploaded pictures
  • City
  • Sexual orientation
  • Degree
  • Whether you smoke
  • Whether you want children
  • Whether you have children
  • Whether you want to get married
  • Chat history
  • Likes you give out

You can have these data sent to your email. To do so, go to your profile in the app under Settings -> Saved data. We do not use your email to send you advertising mails. If you want to subscribe to our newsletter, you can do it here.

When you take part in surveys, you tell us what you think about our services, answer our questions, and report your experiences.

When you participate in our promotions, events or contests, we collect the information you use to register or participate.

When you contact our customer service, we collect the information you provide us during the communication. We do not monitor or record this information.

We do not receive information about you from third parties!

We process your information to fulfil the contract you have entered into with us. While you use our services to get in contact with other users, we use your data to maintain your account and profile and make it visible to other users.

4. To whom we pass on your data

As it is our service to introduce you to other users, we mainly pass on your user data to other registered users in the app. So all information you have entered in your profile is visible to other users registered in the app and is public within the app.

Therefore be careful with your data and pictures. Please read our Safety tips and Community guidelines.

If you do not want certain users to see your profile, you can block them.

Your data must be stored on a server. It was extremely important to us that your data does not leave the country (Germany). Therefore the Google Cloud Platform server is located in Frankfurt, where your data is processed and stored.

In legally required cases we may pass on your data. This would be: (i) to comply with a legal process, such as a court order, subpoena or search warrant, governmental/criminal investigation or other legal requirement; (ii) to assist in the prevention or investigation of crime (in each case in accordance with applicable law); or (iii) to protect the safety of another person.

We will not share your information for advertising services.

5. Your rights

To control your data in the app, you have the following options:

  • Device permissions: Turn on and off push notifications or camera use and access to your photo albums
  • View your stored data: You can send your stored data to you by email at any time via the app (siehe Section 3)
  • Delete your profile and/or account
  • Uninstall: You can uninstall the app from your device, the unique ID of your device will not be saved. This means that if you install the app again, we cannot associate any previous transactions or activities with your device.
  • Accountability: In countries of the European Union, you have the right to lodge a complaint with the relevant data protection authority if you have concerns about our processing of your personal data. The data protection authority to which you can lodge a complaint may be that of your usual place of residence, your place of employment or a jurisdiction where we are located.

It may also happen that we are unable to comply with certain requests to revoke the processing of personal data, especially if this would mean that we would no longer be able to provide you with our services. For example, you cannot use the App if we do not know your date of birth (you must be 18 years or older to use the App).

6. How we protect your data

We strive to protect your personal information from unauthorized access, alteration, disclosure or destruction. Although we take preventative measures to protect your information, we cannot promise, as all technology companies do, that your personal information will always remain secure.

We regularly check our systems for possible vulnerabilities and attacks. Therefore, there will always be updates of the app.

We may suspend your use of some or all of our services without notice if we suspect or discover any breach of security.

If you believe that your account or data is no longer secure, please notify us immediately via our contact form.

7. How long do we store your data

We will retain your personal information only for as long as we need it for legitimate business purposes (as set out in section 3) and as permitted by applicable law.

If you choose to delete your profile or account, your data will be immediately and irrevocably deleted.

This also applies to chat messages you have had with other users and to Likes you have shared. These will also be deleted, also in the chat history of the users you have written with.

8. Privacy of children

We have an age limit for the use of our app, which requires that you are at least 18 years old.

We do not allow users under the age of 18 to use our app and we do not knowingly collect information from minors. If you suspect that a user is underage, please report them to us immediately using the reporting function available in our app.

9. Google Analytics

We use Google Analytics (Google Inc., Ireland Ltd., Gordon House, Barrow Street, Dublin 4, Ireland) in order to work with the additional function offered by Google for the anonymisation of IP addresses: Here the IP address of Google is usually already shortened within the EU and only in exceptional cases only in the USA and in any case only stored in shortened form.

On our behalf, Google analyses the use of the App in order to evaluate your use of the App, to compile reports on the activities on the App and to provide us with further services associated with App use and Internet use, such as Google Analytics reports on performance according to demographic characteristics and interests.

You can find out how and to what extent Google processes data at https://policies.google.com/privacy?hl=en.

We do not use the Google Analytics advertising function.

Google Firebase

We also use the tools Google Analytics for Firebase and Firebase Crashlytics from the Google Firebase platform of Google Ireland Ltd (Gordon House, Barrow Street, Dublin 4, Ireland; “Google”).

Google Firebase offers a variety of features, which are presented on the following website https://firebase.google.com/products/. These features may access and store personal information about users, such as content created or information regarding their interaction with the Apps. Firebase also offers interfaces that allow interaction between the users of the app and other services.

Google Analytics for Firebase and Firebase Crashlytics collect data such as when the App is opened for the first time, uninstalled, updated, crashed or how often the App is used. Certain user interests are also evaluated. For this purpose Google accesses the Advertising ID of the end device.

The information processed by Google Firebase may be used in conjunction with other Google services, such as the Google marketing services. In this case, information such as the Android Advertising ID or the Advertising Identifier for iOS is processed to identify mobile devices of the users. For more information about Google’s use of data, please visit the overview page https://www.google.com/policies/technologies/ads. The Google Privacy Policy can be found at https://www.google.com/policies/privacy.

Since it is very important to us that all data remain in Germany, we cannot exclude the possibility that your data may be transferred to the USA. Google is certified under the Privacy Shield Agreement. (https://www.privacyshield.gov/participant?id=a2zt000000001L5AAI&status=Active)

10. Google Admob

The Lite (free) version of the app uses the Google Admob service to display ads.

Ads are personalized based on the device you are using. You can disable this through the Settings on your device.

On devices running the iOS operating system, Apple’s ad ID is used. For more information on ad tracking using this ad ID, go to Settings on your device.

The Google Admob service is provided by Google (Google Inc., 1600 Amphitheatre Parkway Mountain View, CA 94043, USA). Google is certified under the Privacy Shield agreement and thereby offers a guarantee of compliance with European data protection law (https://www.privacyshield.gov/participant?id=a2zt000000001L5AAI&status=Active).

General information about the handling of user data can be found in Google’s privacy policy.
